The meeting of the Town Council was called to order by Mayor Scott Pearson at 2:00 p.m. on Thursday, April 23,
2026. The meeting was held in person with virtual access provided through Zoom.

On a MOTION by Tucker Magid and seconded by Pete Duprey, Council voted unanimously to move into
Executive Session at 2:03 p.m. for the purpose of:

b. Consideration of Approval of an IGA for Noxious Weed Management and Control Services
c. Consideration of Approval of Updated Transit Compliance Plans-Title VI Plan, Language
Assistance Plan (LAP). and ADA Service Plan
Town Clerk Susan Johnston and Transit and Recreation Director Jim Loebe presented. Council discussion ensued.
On a MOTION by Dan Jansen and seconded by Pete Duprey, Council voted unanimously to approve the consent
agenda as presented.

a. Appointment of One Seat on the Building Board of Appeals

Chief Building Official Lars Forsythe presented. On a MOTION by Alline Arguelles and seconded by Pete
Duprey, Council voted (5 -0) (with Dan Jansen and Huascar E Gomez absent) to appoint Luke Trujillo the
Building Board of Appeals.
b. One Mountain Villa.ge Plaza Vending Community At-Large Seat for a Two-Year Term
Business Development Manager Molly Norton presented. On a MOTION by Scott Pearson and seconded by
Tucker Magid, Council voted (7 -0) to appoint Alison Wright to the Mountain Village Plaza Vending Community
At-Large seat for a two-year term expiring April 2028.
c. Appointment of Open Seats to the Design Review Board
Community Development Director Amy Ward presented. On a MOTION by Pete Duprey and seconded by
Tucker Magid, Council voted (7 -0) to appoint Banks Brown, Adam Miller, David Eckman, Scott Bennett to the 4
regular open seats on the Mountain Village Design Review Board for a four-year term expiring May 2030 and to
appoint Jim Austin to the Mountain Village Design Review Board alternate seat for a four year term expiring May
2030. On a MOTION by Alline Arguelles and seconded by Tucker Magid, Council voted (7 -0) to appoint Tobin
Brown to the alternate seat on the Design Review Board for the Town of Mountain Village, filling the vacancy left
by David Eckman for the remainder of the term, which expires in June 2027.
Department Updates and Business & Government Activity Report (BAGAR) (6)
Assistant Town Manager Michelle Bulson and Lizbeth Lemley presented. Council discussion ensued.
Council took a dinner break from 6:20 p.m. to 6:30 p .m. and then moved to item 15.
Review of2025 Forestiy Projects and Forestiy Update (7)
Town Forester Rodney Walters presented. Council discussion ensued.
Consideration of a Resolution Approving a Conditional Use Permit Development Application on Lot 382R
for a Padel Court, Pursuant to CDC Section 17 .4.14 The Applica11t has Asked that This Item be Continued
to the May 21 2026 Town Council Meeting (8)
Senior Planner Daniel Alvarado presented. Council discussion ensued. On a MOTION by Huascar E. Gomez
(Rick) and seconded by Dan Jansen, Council voted unanimously to continue consideration of a Resolution
approving a conditional use permit for a padel court at Lot 382R, 112 Autumn Ln, pursuant to CDC Section
17.4.14. to the May 21, 2026 Town Council meeting.
Second Reading. Public Hearing and Council Vote on an Ordinance Regarding Community Development
Code (CDC) Amendments for Compliance with Colorado Wildfire Resilience Code (CWRC) (9)
Daniel Alvarado, Amy \Vard, Lars Forsythe, and Rodeny Walters presented. Council discussion ensued. The Mayor
opened the public hearing. Public comment was received by Doug Tooley. The Mayor closed the public hearing.
On a MOTION by Huascar E. Gomez (Rick) and seconded by Alline Arguelles, Council voted (7 -0) to approve
on second reading an Ordinance regarding Community Development Code (CDC) amendments to CDC Section
17.5.6: Building Design and adding section 17.7.22: Colorado Wildfire Resiliency Code (CWRC) with the addition
of the amendments to chapters 1 and 2 of the CWRC to implement additional thresholds for compliance; with an
effective date of July 1, 2026 and with the clarification that fees can be adjusted by resolution, and with administerial
edits to part XIII of section 1B.

First Reading, Setting of a Public Hearing and Council Vote on an Ordinance Regarding Community
Development Code Amendments to Section 17.5.12 Lighting Regulations This Item was Continued from
the Febwarv 19, 2026 Regular Meeting (11)
Amy Ward presented. Council discussion ensued. The Mayor opened public comment. Public comments were
received by Cath Jett, Katie Sapp, Robert Grossman, and Doug Tooley. The Mayor closed public comment. On a
MOTION by Scott Pearson and seconded by Pete Duprey, Council voted (5 -1) (with Huascar E. Gomez absent
and Harvey Mogenson dissenting) to approve on first reading an Ordinance regarding Community Development
Code amendments to section 17.5.12 Lighting Regulations and to set the second reading, public hearing and final
Council vote for May 21, 2026 with the following modifications:
a. Permit motion-activated lights at the entrance of a home
b . Address how existing homes with soffit lighting above the allowable height will be able to come into
compliance when required at the 5-and 10-year compliance periods.
c. Provide a process that allows for reasonable review and accommodation for homeowners who are required
to make changes
d. Explore incentive programs
First Reading, Setting of a Public Hearing, and Council Vote on an Ordinance Amending Chapter 17.7 of
the Municipal Code (12)
Town Attorney David McConaughy and Lars Forsythe presented. Council discussion ensued. On a MOTION by
Pete Duprey and seconded by Alline Arguelles, Council voted (7 -0) to approve on first reading an Ordinance
amending Chapter 17. 7 of the municipal code and to set the second reading, public hearing and final Council vote
for May 21, 2026.
Second Reading, Public Hearing and Council Vote on an Ordinance Creating a Background Check
Process for Prospective Massage Facility Operators, Owners, and Employees (13)
David McConaughy presented. Council discussion ensued. The Mayor opened the public hearing. No public
comment was received. The Mayor closed the public hearing. On a MOTION by Pete Duprey and seconded by
Tucker Magid, Council voted (7 -0) to approve on second reading an Ordinance creating a background check
process for prospective massage facility operators, owners, and employees.

Mountain Village Municipal Code (14)
David McConaughy presented. Council discussion ensued. The Mayor opened the public hearing. No public
comment was received. The Mayor closed the public hearing. On a MOTION by Alline Arguelles and seconded by
Huascar E Gomez/Duprey, Council voted (7 -0) to approve on second reading an Ordinance adjusting certain
penalties in the Mountain Village Municipal Code.

Consideration of an Emergency Ordinance Amending Chapter 13.03 of the Mountain Village Municipal
Code to Authorize Staff to Impose Water Usage Restrictions in Times of Drought or Emergency and to
.Provide Penalties for Violations (16)
David McConaughy presented. Council discussion ensued. The Mayor opened the public hearing. Public comment
was received by Cath Jett. The Mayor closed the public hearing. On a MOTION by Pete Duprey and seconded by
Alline Arguelles, Council voted (6 -0) (with Huascar E . Gomez absent) to approve an Emergency Ordinance,
effective immediately, amending chapter 13.03 of the Mountain Village Municipal Code to authorize staff to impose
water usage restrictions in times of drought or emergency and to provide penalties for violations.
On a MOTION by Tucker Magid, and seconded by Alline Arguelles, Council voted unanimously to extend the
meeting beyond 6 hours
Discussion Regarding a Density Transfer and Rezone at Lot 152R TBD Country Club Drive This item was
Continued from the Fehrua 19. 2026 Town Council Meetin and bas been tabled 17
