The meeting of the Town Council was called to order by Mayor Scott Pearson at 2:00 p.m. on Thursday, May 21,
2026. The meeting was held virtually with access provided through Zoom.

Town Clerk Susan Johnston presented. Council member Huascar E. Gomez (Rick) read the proclamation. Lauren
Knobbe with Tri-County Health Network accepterl tht'. proclamation and thanked Council for their support. On a
MOTION by Huascar E. Gomez (Rick) and seconded by Dan Jansen, Council voted unanimously to declare May
2026 as Mental Health Awareness month.
Public comment was taken after item 3.

All matters in the Consent Agenda are considered to be routine by the Town Council and will be enacted
with a single vote. There will be no separate discussion of these items. If discussion i deemed necessary,
that item should be removed from the Consent Agenda and considered separately:

Susan Johnston, Transit and Recreation Director Jim Loe be, and Executive Director of Norwood Park and
Recreation District Liza Tanguay presented. Council discussion ensued. On a MOTION by Harvey Mogenson and
seconded by Huascar E. Gomez (Rick), Council voted unanimously to approve items A and D on the consent
agenda. Items Band C were removed from the consent agenda for further discussion. On a MOTION by Harvey
Mogenson and seconded by Huascar E. Gomez (Rick), Council voted unanimously to approve item B on the
consent agenda. Public comment was received by Johnathan Greenspan. On a MOTION by Pete Duprey and
seconded by Alline Arguelles, Council voted unanimously to approve item C on the consent agenda
On a MOTION by Huascar E. Gomez (Rick) and seconded by Pete Duprey, Council voted unanimously to
convene as the Town of Mountain Village Liquor Licensing Authority.

Susan Johnston and Telluride Food & Vine representative Meehan Fee presented. Council discussion ensued. The
Mayor opened a public hearing. No public comment was received. The Mayor closed the public hearing. On a
MOTION by Huascar E. Gomez (Rick) and seconded by Pete Duprey, Council voted (6 -0) (with Tucker Mgid
absent) to approve the application for a special event permit by San Miguel Mentoring in conjunction with Telluride
Food & Vine for two events on June 12 & June 13 in the Conference Center Plaza.
On a MOTION by Huascar E. Gomez (Rick) and seconded by Dan Jansen, Council voted unanimously to
reconvene as the Town of Mountain Village Town Council.
Department Updates and Business & Government Activity Report (BAGAR) (6)
Assistant Town Manager Michelle Bulson and Finance Director Lizbeth Lemley presented. Council discussion
ensued.
Consideration of a Resolution Appropriating Additional Sums of Money to the 2026 Budget (7)
Lizbeth Lemley presented. Council discussion ensued. Public comment was received by Jonathan Greenspan. On a
MOTION by Pete Duprey and seconded by Alline Arguelles, Council voted unanimously to approve a Resolution
appropriating additional sums of money for the 2026 Budget year.
Consideration of Approval of the 2026 Financials through March 31, 2026 (8)
Lizbeth Lemley presented. Council discussion ensued. On a MOTION by Pete Duprey and seconded by Harvey
Mogenson, Council voted unanimously to approve the 2026 Financials through March 31, 2026.
Economic Update Discussion and Review of Historical Financial Performance (9)
Lizbeth Lemley presented. Council discussion ensued.
Consideration of Approval of a Resolution Amending the 2026 Mountain Munchkins Fee Schedule (10)
Lizbeth Lemley presented. Council discussion ensued. On a MOTION by Alline Arguelles and seconded by
Huascar E. Gomez (Rick), Council voted unanimously to approve a Resolution amending the 2026 Mountain
Munchkins fee schedule.
Second Reading, Public Hearing and Council Vote on an Ordinance Regarding Community Development
Code Amendments to Section 17 .5.12 Lighting Regulations To Be Continued to the J une 17, 2026 Town

Community Development Director Amy Ward presented. Council discussion ensued. On a MOTION by Huascar
E. Gomez (Rick) and seconded by Dan Jansen, Council voted unanimously to continue the second reading, public
hearing and council vote on an Ordinance regarding community development code amendments to section 17.5.12
Lighting Regulations to the June 17, 2026, Town Council meeting.
First Reading. Setting of a Public Hearing and Council Vote on an Ordinance Regarding a Rezone and
Density Transfer at Lot 640A. 306 Adams Ranch Rd. to Add 15 Units of Employee Apartment Density (12)
Amy Ward and Ponderosa Planning and Design representative John Miller presented. Council discussion ensued.
The Mayor opened public comment. Public comment was received by Cath Jett. The Mayor closed public
comment. On a MOTION by Scott Pearson and seconded by Pete Duprey, Council voted (4 -2) (with Tucker
Magid absent and Harvey Mogenson and Dan Jansen dissenting) to approve on first reading an Ordinance

regarding a rezone and density transfer at Lot 640A, 306 Adams Ranch Rd, based on the staff memo of record
dated May 12, 2026 and the findings of this meeting, and direct the Town Clerk to set a public hearing for July 16,
2026, with the following findings and conditions:
Findings:
- Criteria for decision for a rezoning have been met
- General conformance with the Comprehensive Plan has been found
- Density transfer criteria has been met
Conditions: - The conceptual design proposed as part of this application is approved through a Class 3 Design Review
Process by the DRB. - A s11hclivision :ipplic.arion is approved showine revised lot lines to accommodate the building envelope and
roof overhangs without encroachment into the GE - A landscaping plan is presented to the Town Council for its approval, and the Town Council approves a
landscaping plan that appropriately retains greenspace and screens the building from Adam's Ranch Road to
the acceptance of the Town Council. - If conditions 1, 2, and 3 are not met prior to the expiration of the approval for this rezone and density
transfer, this approval for rezone and density transfer is null and void
Second Reading, Public Hearing, and Council Vote on an Ordinance Amending Chapter 17.7 Building
Regulations of the Municipal Code (13)
Chief Building Official Lars Forsythe and Town Attorney David McConaughy presented. Council discussion
ensued. The Mayor opened a public hearing. No public comment was received. The Mayor closed the public
hearing. On a MOTION by Pete Duprey and seconded by Dan Jansen, Council voted (6 - 0)(with Tucker Mgid
absent) to approve on second reading an Ordinance amending chapter 17.7 building regulations of the Town of
Mountain Village municipal code.
Emergencv Evacuation Planning and Municipal Disaster Management Presentation (14)
Council continued this item to a later date.
Transportation (15):
a. Consideration of Approval of a Resolution Adopting the Telluride and Mountain Village
Transportation Safety Action Plan
Senior Planner Daniel Alvarado and Alta Consultant Jonny Rotheram presented. Council discussion ensued. On a
MOTION by Pete Duprey and seconded by Alline Arguelles, Council voted unanimously to approve of a
Resolution adopting the Telluride and Mountain Village transportation Safety Action Plan and allow staff to
continue to make clerical, illustrative, and administrative changes to the plan.
b. Consideration of Approval of a Resolution Adopting Vision Zero as a Town Policy in Conjunction
with the Telluride and Mountain Village Transportation Safety-Action Plan
Daniel Alvarado presented. Council discussion ensued. On a MOTION by Pete Duprey and seconded by Huascar
E . Gomez (Rick), Council voted unanimously to approve of a Resolution adopting Vision Zero as a Town policy in
conjunction with the Telluride and Mountain Village Transportation Safety Action Plan.

Consideration of a Resolution Approving a Conditional Use Permit Development Application on Lot 382R
for a Padel Court, Pursuant to CDC Section 17 .4.14. This Item was Continued from the Apt:il 23, 2026

Daniel Alvarado presented. Council discussion ensued. On a MOTION by Dan Jansen and seconded by Alline
Arguelles, Council voted unanimously to adopt a Resolution approving a 3-year, Automatically-Renewing
Conditional Use Permit for a padel court on 112 Autumn Ln, based on evidence provided within the staff report of
record dated May 12, 2026, with the following condition:
The Town reserves the right to impose additional, reasonable mitigation requirements if impacts to adjacent
properties or the environment are identified. Failure to meet reasonable mitigation requirements may result in
revocation of the Conditional Use Permit via a new Conditional Use Permit approval process.
Consideration of Approval of a Road Right of Wav Encroachment Agreement for Lot 360. 101 Snowfield
Drive for Subterranean Soil Nail Shoring Below the Right of Way (17)
Daniel Alvarado presented. Council discussion ensued. On a MOTION by Dan Jansen and seconded by Huascar
E. Gomez (Rick), Council voted unanimously to approve of a Road Right of Way Encroachment Agreement for
Lot 360, 101 Snowfield Drive for a subterranean soil nail shoring below the right of way, as identified in exhibit B,
based on the evidence provided in the staff memo of record dated May 8, 2026.
Consideration of ApprovaJ of an Earth.work Easement Vacation for Lot 424, 121 Touchdown Drive (18)
Daniel Alavarado presented. Council discussion ensued. On a MOTION by Pete Duprey and seconded by Huascar
E. Gomez (Rick), Council voted unanimously to approve the vacation of Earthwork Easements on Lot 424, as
identified in exhibit B, based on the evidence provided within the staff report of record dated May 11, 2026.
